What will happen at the hearing?

As the applicant is the person disputing the appropriateness of the transfer they will be asked by the Tribunal to, either in person or by their advocate or support person, present to the Tribunal material which would show that the transfer is in some way damaging to the patient.

Having heard this material the representatives of the treating teams of both hospitals will be asked whether there are therapeutic benefits to the patient provided by the transfer which should override the patient's reluctance to be transferred.

All parties present will be invited to comment on the material provided by the other parties and summarize their views as to the benefits/ disadvantages of such a transfer.
