If no application has been received by the Tribunal, the hearing will occur automatically within 28 days of the order being made or renewed - unless the order has been discharged prior to the hearing date.
If an application has been received by the Tribunal, the hearing will be held as soon as practicable but no later than 21 days after receipt of the application. In the case of an application the hearing can continue whether or not the patient has been discharged.
The patient and the person responsible (including the person who applied for the review) will be notified by the Tribunal of the time and place of the hearing.
The hearing will be held in the facility where the person who is the subject of the hearing resides or receives treatment.
