How do I make application to the Tribunal to withhold information from the patient at the hearing?

If for any reason the report is not read to or by the patient, or any part of the report is not disclosed to the patient, the Registrar of the Tribunal should be notified of the information which was withheld and the reasons why, at least 24 hours prior to the hearing.

This can be done by completing an Application to Withhold Information Form.

It is for the Tribunal to determine if information should be withheld from the patient and this will be done by conducting an inquiry, in the patient's absence, prior to the commencement of the hearing.

At this inquiry you will need to satisfy the Tribunal that the disclosure of the information in question would:

The Tribunal will make a ruling on whether information is to be withheld after listening to the reasons why, in your opinion, the information should not be revealed to the patient but should be taken into account by the Tribunal in the decision making process.

Any information which the Tribunal rules should not be disclosed will not be referred to in the hearing but will be taken into account in the Tribunal's deliberations.
